STUD FEE For WYO BLUE CHIPS In consideration of TSRC FARMS INC. and Tom Keenan entering into this contract and reserving breedings for the owner/leaser of the mare during breeding season, the mare owner/leaser agrees to pay TSRC FARMS INC. a stud fee of $400.00 as soon as the mare is found in foal. If cooled semen is to be shipped, the full $400.00 stud fee must be paid in advance of the actual estimated date of shipment. Other charges for cooled shipped semen are a $100.00 collection fee per shipment, a $30.00 container use fee per shipment, and actual freight charges on the container to and from the shipping location. 4. LIVE FOAL GUARANTEE This contract contains a live foal guarantee. A live foal is defined as a newborn which stands and nurses without assistance. If a foal is born dead, or dies within 7 days of foaling, the mare will be allowed a free stud fee only. Mare owner must pay mare care if brought to the farm to breed, or collection fees, container charges and freight on containers if cooled semen is to be shipped. 5. REFUND OF FEE If the stallion should die, be sold, or incapable of servicing the mare, the stud fee only, shall be refunded. Mare care, shipped semen, collection fees, container usage fees or shipping charges are not refundable. 6. REQUEST FOR COOLED SHIPPED SEMEN Working with cooled shipped semen takes coordination between stallion owner, mare owner, and your local vet. If this is the first attempt, please visit with your vet and also with Tom Keenan well in advance of breeding season, so everyone fully understands what is involved. Estimated expected breeding dates are helpful to us. If the mare has a colt, will you be breeding on foal heat or at 28-30 days, let me know! Request for cooled semen should be made 2 days in advance, if possible. With last minute request, we will try to help you out. 7. ON FARM BREEDING We use artificial insemination on this breeding farm. When you call to bring your mare, we can inform you of what nights we are breeding. When your mare has a colt, call and let us know when you are planning on breeding, foal heat or 28-30 days. With open mares, let us know when you want her bred and also if she has cycled this year or has been ultra sounded. Is she a maiden mare or aged mare? Any history you know may increase her chances of getting in foal. Please call before picking up and delivering mares so we can have someone available to help load, unload or pen your mare on arrival. 8. MARE CARE Charges for mare care are $5.00 per day. Mares brought in poor condition (thin), will be charged $7.50 per day and fed to gain weight. 9. VETERINARY CARE Owner/Leaser of mare shall pay any and all charges for veterinary services and supplies provided to the mare and or colt at side to TSRC FARMS INC. In return, TSRC FARMS INC. will provide to the mare owner, copies of receipts for services rendered by veterinarian. Ultra sounds are considered a normal breeding expense and are highly used on this breeding farm and will be performed when needed, at mare owners expense. BY SIGNING THIS CONTRACT, PERMISSION TO HAVE AN ULTRASOUND PERFORMED, IS AUTOMATICALLY GRANTED TO TSRC FARMS INC. Mare owner is responsible for having mare checked in foal by a veterinarian, if not diagnosed as pregnant before leaving the stallion owners facilities. 10. STALLION OWNER LIABILITY TSRC FARMS INC. or Tom Keenan shall not be responsible for any disease, illness, injury, accident or death to the mare or her foal. It is the responsibility of the mare owner/leaser to inspect the stallion owner's facilities. If mare owner/leaser finds the facility unacceptable, they should not leave the mare in the care of TSRC FARMS INC. or Tom Keenan. It is the responsibility of the mare owner/leaser to provide their own insurance on the mare and or foal if so desired. 11. CONDITION OF ANIMALS Mare owner/leaser warrants and represents to TSRC FARMS INC. and Tom Keenan that when their mare and or foal are delivered for breeding, that the mare and or foal are in sound condition, free from any sickness, illness, injury or disease. Should an emergency situation occur that requires prompt veterinarian attention, all efforts will be made to notify the mare/leaser as soon as possible. The mare owner/leaser will still accept financial liability for any emergency veterinarian incurred expenses. 12. DISPOSITION OF THE MARE Mare owner/leaser represents and warrants to TSRC FARMS INC. and Tom Keenan that the mare is gentle and halter broke and has no vices except those listed here ...................................................................................................... ............................................................................................................................................. ............................................................................................................................................. 13. MARE REGISTRATION PAPER AND LEASE AGREEMENT When a mare is delivered to TSRC Farms INC. and Tom Keenan's breeding facility, the owner/leaser shall give a true copy of front and back of mare's registration papers and a true copy of any lease on the mare. 14. BREEDERS CERTIFICATES Breeders certificates will be mailed out as soon as possible after they are received from the breed organizations, AQHA, APHA, etc. ONLY THOSE MARESTHAT REPORTED BACK AS PREGNANT AND OR THEIR OWNER/LEASER HAVE FULLY PAID UP THEIR STUD FEE, MARE CARE, SHIPPING CONTAINER FEES, COLLECTION FEES, VETERINARIAN EXPENSES AND FREIGHT COST BY SEPTEMBER 1st SHALL BE LISTED ON THE STALLION BREEDING REPORT SENT TO THEIR RESPECTIVE ASSOCIATIONS. THOSE REFUSING TO PAY BY SEPTEMBER 1st SHALL BE AN UNREGISTERABLE GRADE COLT. FUTURE ACCESS TO BREEDING IN THE FUTURE WILL BE DENIED! 15. CONTRACT FULL AGREEMENT This writing is a full and complete agreement between the parties concerning the breeding of the owner/leaser's mare and all matters relating to it. There are no other agreements between the parties, written, oral or otherwise, other than this agreement 16. MODIFICATION OF CONTRACT This contract may not be modified unless such modifications are in writing and signed and mutually agreed upon by both Tom Keenan and the mare owner/leaser of the mare. ATTORNEY FEES AND COST In the event that any action, suit or other legal proceeding arises concerning this contract or its provisions, the prevailing party shall recover reasonable attorney's fees, court cost, suit or action expenses including deposition cost and expert witness fees, and court cost from the other party, both at trial and any appeals. This agreement completely replaces and supercedes any and all prior agreements or understandings between the parties concerning this matter, and also replaces and supercedes any representation or implied agreements contained in any advertisement concerning breeding by TSRC FARMS INC. or Tom Keenan's stallion.
